Law society AGM fails to take off

MASERU — The annual general meeting (AGM) of the Law Society of Lesotho failed to take place on Friday after only 42 of the society’s 234 attended the meeting.
Under the Law Society’s regulations, an AGM can only be held when 40 percent of the membership, which means 93 members, is present.
The AGM, which was also supposed to be an elective conference for new members, will now take place next Friday.
This was the second time that the AGM has been postponed.
The first meeting failed to take place on December 2, also for lack of a quorum.
Law Society of Lesotho outgoing president, Zwelakhe Mda, adjourned the Friday meeting for 15 minutes for consultations.
“We have made a resolution regarding the state of affairs presently. Section 16 of the Law Society’s Act 1983 says if there is no quorum no business shall be dealt with, but the meeting shall stand adjourned for seven days till quorum is reached,” Mda said.
“We have resolved that the meeting be postponed to December 16.”
But some members of the law society had earlier argued that the meeting should have gone ahead as the membership could not continue to be held to ransom by the absent members.
Attorney Qhalehang Letsika said the lack of a quorum has always haunted the law society in previous meetings.
He said the meeting should have gone ahead as there were some pressing issues that needed urgent attention.
Letsika said with the High Court closing for the Christmas holidays it was critical that important issues relating to the organisation be discussed and finalised.
“We have no choice but to break the law,” Letsika said.
