Woman sued M1million for adultery

A Ha ‘Nelese woman is demanding M1million from her husband’s lover for ruining her six-year-old marriage.

Mpoi ‘Malengoasa Mankimane claims ‘Matumiso Nkeletseng Mokone’s “adulterous” relationship with her husband, Makhathe Mankimane, cost her “comfort and services”, hence the lawsuit she filed before the High Court on Wednesday.

In court papers filed through her lawyers MW Mukhawana Attorneys, Ms Mankimane noted she married her husband on 27 November 2009 and the couple had one child.

According to Ms Mankimane, during the course of the marriage, Ms Mokone was involved in a relationship with her husband, which eventually saw her filing for divorce.

Ms Mankimane added she “did not authorise or allow the defendant (Ms Mokone) to get into an adulterous relationship” with her husband “thus the said adulterous relationship was wrongful and unlawful”.

The lawyers note in the court papers: “As a result of the wrongful, unlawful and adulterous acts of the defendant (Ms Mokone), the plaintiff (Ms Mankimane) suffered damages in that her love for her husband was lost; she had to undergo divorce proceedings; she lost consortium of her husband; she lost family companionship and social order.”

The lawyers continue: “As a result of the defendant’s wrongful and unlawful acts of adultery, the plaintiff suffered loss of comfort, society and services of her husband and she was emotionally affected all of which she holds the defendant liable to compensate in damages she suffered in the amount of M1million….with interest at the rate of 18.5 percent per annum from the date of the summons (14 October 2015) to the date of the final payment”.

Ms Mankimane also wants Ms Mankimane to pay the costs of the suit.

Ms Mokone, who lives in Ha Thetsane, was given 14 days to defend herself against the claim.

Meanwhile, Ms Mokone has since ended her 13-year-old marriage to her husband. According to papers filed before the High Court on 16 March 2015, she says her relationship with her husband had become “intolerable, insupportable and dangerous”.

She accuses the husband of adultery, adding each time she confronted him, he would assault her “and as a result, I was forced to leave the matrimonial home in September 2014.

Out of frustration, she noted, she “met and started a love relationship with Makathe Mankimane”.

She therefore asked the court “to condone” this relationship.
