The Lesotho Times edition of 3 December 2015 carried a story headlined ‘Judge to sue MP over Kamoli’.
It has since been brought to our attention that Justice Molefi Makara “never in his judgment stated in precise or implied terms” that he was going to sue the MP.
According to the Registrar of the High Court and Court of Appeal, Advocate Lesitsi Mokeke, the judge instead said he accepts the advice from counsel that he consults the Attorney General in the matter.
Advocate Mokeke further pointed out that “the Attorney General has constitutional duty to protect the dignity of the courts from unfounded attacks”, and as such a decision or measures to be taken would be made by the Attorney General and not the judge.
“The form of the publication turns to project a wrong picture that basically there is a confrontation between the judge and the commander of Lesotho Defence Force. Some of the details in the affidavit are not foreshadowed in the affidavit from what could have transpired,” said Advocate Mokeke.
