Advocate Molapo disputes Ms Maboikanyo’s claim that she only received a Toyota GD6 bakkie and a taxi from the fleet, alleging that she had established business properties for Hlahla, without Mr Matoetoe’s knowledge.
“I put it to you that you bought your son four vehicles, including two taxis, and created a business consisting of eight rented units. These investments were not equally made for the other children from your second marriage with the plaintiff. The profits from these businesses go directly into your accounts, and you alone benefit from that money,” Adv Molapo said.
Ms Maboikanyo admitted to purchasing the properties for her son but explained that they were funded by a loan which she is still repaying using proceeds from a Toyota GD6 bakkie that she rents out to the government.
She contended that earnings from her son’s businesses are used to support all her children, including the son in question.
In a complicated twist to the property wrangle, some of the vehicles Ms Maboikanyo is claiming are not registered in the couple’s names but in the names of Mr Matoetoe’s relatives.
Advocate Molapo questioned, “How can you demand vehicles that do not belong to you as a couple?”
In response, Ms Maboikanyo said that although the vehicles were not in their names, they were purchased with their combined funds. She claimed that the vehicles were registered under different names to “hide them” and accused her ex-husband of unlawfully allocating part of the estate fleet to his biological children and family.
Advocate Molapo also expressed concern about Ms Maboikanyo’s refusal to disclose all her bank accounts as previously ordered.
He asked, “We agreed that all parties should submit their bank details, but you chose not to disclose one account. Why?”
“I didn’t think the other account was significant since my husband didn’t reveal all his accounts,” Ms Maboikanyo said, in response.
Mr Matoetoe wants his ex-wife to keep the properties already in her possession, while he also keeps what is in his possession.
However, the Ms Maboikanyo shot down that suggestion, demanding the return of the estate’s vehicles already allocated to the former husband’s biological family so that both parties can share the properties equally.
The case, which also includes a dispute over two residential sites, was heard in the Northern Division of the High Court in Ts’ifa-li-Mali, presided over by Justice Itumeleng Shale.
