15-year -old raped in sex orgy

MASERU — Two men are facing a charge of rape and failure to report an offence after they were allegedly involved in a sex orgy with a minor.
Patrick Khechane, 20, and Lebusa Mokoka, 19, of Ha-Rathoko in Maseru appeared before the Maseru Magistrate’s Court on Friday.
Mokoka is alleged to have raped the 15-year-old girl, who was a virgin, after watching in excitement his friend Khechane having sex with his girlfriend.
The four, together with a fifth person, were all in the same room and were reclining on the same bed when Khechane and his girlfriend were having sex.
Khechane is said to have invited his friend, Mokoka, to visit his girlfriend’s place where they all slept on the bed.
Khechane then had sex with his girlfriend, only identified as Lebohang, in full view of Mokoka who got aroused and started fondling the little girl.
The prosecution said three witnesses, who included the complainant, told the court that Mokoka at one stage fondled her and tried to remove her panties.
“She told the court that Mokoka overpowered her and inserted his sex organ inside her private parts,” the prosecutor said.
The prosecutor submitted that Mokoka had failed to rebut these allegations except to ask the complainant questions clarifying how the act was done.
The complainant had told the court that Khechane who was sleeping with his girlfriend was present when these things happened, but laughed at them and at no stage did he take steps to report the matter to the police.
“It is clear that accused one (Mokoka) could have been influenced by accused two Khechane who was having sex with his girlfriend in his presence,” Pearl Letsoela, the prosecutor, said.
The prosecution submitted that the two accused only elected to give different versions without challenging or denying the allegations levelled against them.
“Their silence inferred that they agreed with evidence tendered by the prosecution witnesses,” Letsoela said.
Mokoka told the court that they were from a bar and were drunk and therefore he could not remember what happened on that day.
The prosecution said a medical report presented before the court showed that the complainant was of a tender age, was not sexually active and her virginity had been violated.
Mokoka however insisted that he was not guilty and never had any sexual intercourse with the complainant.
Khechane told the court that he did not see the alleged sexual act taking place between Mokoka and the complainant.
He said he only came to know about the allegation late adding he would have reported the matter to the police if he knew about it.
Mokoka is being charged with rape while Khechane is being charged with failure to report an offence.
The crimes allegedly took place on June 14 at Ha-Rathoko, about 20 km from Maseru.
At the end of the crown case, the prosecutor asked the court to convict Khechane as well.
The accused are charged with contravening Sexual Offences Act No.3 of 2003.
The prosecutor submitted to the court that in terms of the section 8 (3) of the Sexual Offences Act a person who failed to report an offence is guilty of the offence as well.
The court reserved its ruling to July 23, saying it needed time to consider judgment.
